Application for Naturalization query

Application for Naturalization query

Hi all,

Me and my wife got ILR approval on June 2015, I was on Tier 1 (general) since June 2010 and my wife was my dependant from Feb 2012 (She entered the UK in March 2012). My question is the following,

Can my wife apply with me next year i.e. 2016 for Naturalization or she has to wait an additional year to complete 5 years in the UK?

Any replies with reasoning will be highly appreciated, thanks a lot

I understand that your wife, as the family member (spouse) of a Tier 1 (general) visa holder, needs 5 years living in UK;
she would become eligible in 2017, see:

Thanks a lot for the quick reply, that was my assumption too. But someone suggested old rules apply to her maybe they were wrong?

I don't know about previous rules; I would rely on latest Gov UK website in first place.

Your wife will qualify to apply as spouse of BC as soon as you are approved and have attended your ceremony.

So you should apply first, once all the formalities are done, then your wife can apply and will only need 3 years residence as spouse of BC. She does not have to wait 5 years.

Thanks CR001, I have this as a plan if this really works out I am not sure. I will definitely look into this option for sure :)

It does work, many people do it this way if the one spouse does not have 5 years residence. Once you attend your ceremony and receive your certificate, you are British and your wife can then apply as spouse of BC and 2 years residence even on the same day after your ceremony.

The British spouse does not have to be British born or British since marriage date, you only have to be British on the day your spouse applies under the 3 years residence as spouse of BC.

CR001 has of course, given you excellent advice and personally, I would make use of this rule while it is available. There's no guarantee that this concession for a spouse of a British citizen will always be available and the application fees may well increase in the future.
