Hi,

I am a chinese passport holder who has been in the UK with a residence permit (EEA spousal visa) for the past 5 years. I have applied for a permanent residence visa, however it has been rejected because "no evidence has been provided to show that your spouse has exercised treaty rights in the UK for a continuous period of five years". We included his Irish passport (he was born in ireland and has always had an Irish passport). We also included our tenancy agreement on an apartment we had rented (both our names included) and more recently, a copy of our mortgage (both our names are on this document also)

I am very confused as to why my application has been rejected on these grounds. Is there anything else we need to prove my husbands rights in the UK? We need to reapply now, but are worried that our application will be rejected again due to brexit or the fact he is an EEA citizen living in the UK and his situation may change after brexit.

I have lived in the UK long enough to warrant a permanent residence visa, but very worried that the UK will not approved my visa now because my husband is an EEA national

Yes, you didn't send evidence of exercising treaty rights that your partner is working etc, i.e. payslips, P60s, bank statements etc. Just living in the UK is not sufficient.

Also, where in Ireland was he born?
