Applying child dependent visa for my children

Applying child dependent visa for my children

Both me and my wife are British Citizen by descent when our children were born overseas.

I was studying in England for 10 years but just didn't make it for the 3 years rule. I have been working overseas since graduation.

Hence I would need to apply visas for my children as we are planning to come back to England and I have already had job offer. My current job overseas and future job in UK meet the new financial requirements for family visa. (But my wife doesn't need a visa to come back obviously). Accomodation could be provided by my father-in-law, and of course we need to find one that is closer to my workplace later (is that ok?)

Some advice us to apply for ILR for the children, while some advice us to apply child dependent visa. Are they the same route? If not, which route should I choose?

The children can't apply for ILR directly and you should apply for child dependent visas for them.

However, as both of the parents are British citizens by descent, the children should be issued with ILE (ILR issued outside the UK) automatically.

If the children are younger than 15, after three continuous years of residence in the UK with both parents, they will be entitled to be registered as British citizens otherwise than by descent under Section 3(5). Such registration must take place before their 18th birthday.

They are 8 and 4.5 years old with respectively.

So I should apply child visa separately for them?

I read the post with the link, I just wonder how can I get round the Heathcare Surcharge if that does not apply to my children?

I have prepared all the documentation according to the common family visa route, and I was directed to a paper base application form, is that what I should do?

I was in the same situation. I applied for Child Dependent visa for my child. Once the visa is granted, it will say ILE (not remain, remain is when they're already in the country), they will issue the biometric resident permits when they arrive.

There is no getting around the NHS charge that I know of.

You need to apply online, then they will ask you to go to office to scan a bunch of documents at the office and have your children's pictures and finger prints taken.

ILE is exempt from IHS - which visa are you referring to?

I got the child dependent visa. I just saw it says ILE/ILR no need, I am not sure, but I guess it's because if you apply just for ILR/ILE it means you have previously paid? Anyways, I did need to pay for child dependent visa.
