asylum claim

Post by ikings » Sun Apr 23, 2017 3:32 pm

Hi,
May I inquire pls ? I'm an overstayer from Nigeria since 2007, I have been married to a british citizen since 2014. All our applications were refused But unfortunately last year I was arrested working with false document and sentence to 6 months in prison, I served 3 months . Afterwards I was detained by the HO for 3 months and released on court bail. I claimed asylum in October last year, still awaiting the result. Can I possibly still apply for a spousal visa?
Or what should I do? Pls I need insight! Thanks

Do you have children with your British spouse?
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

On what visa did you enter the UK and what date did this expire?

What applications have you tried to make in the last 10 years and what were the reasons for refusal?

On what basis did you claim asylum?

Did you get approval from HO to marry in 2014?
Char (CR001 not Casa)

I first arrived in 2004 on 6 months visit visa. When it expired I got another 2 years visit visa in 2005 which expired 2007, I remained as overstayer from then.
I made my first application in 2014 on the basis of marriage to a citizen. I was refused on the basis of not having a child. They also claimed I didn't attend my biometric appointment which was false accusation.
I got married without needing approval at the registry even though I made the HO aware I'm getting married and didn't hear from them. The HO recognize my marriage as genuine.
My arrest and imprisonment made everything worse.
My local MP made the Asylum claim on my behalf as I made her aware of the danger I will face if returned to Nigeria. She even forced the HO to review my case which they claimed they did.
My claim is based on 3 reasons: 1. Boko Haram bcos I was raised in the North (Muslim dominated ) and most of my childhood friends joined them 2. I am wanted by a secret cult fraternity group for exposing them. 3. I am also wanted by a criminal gang for exposing them too.
