Australian national with UK residence permit - does this help?

Post by Saintie » Tue Mar 12, 2024 6:01 pm

A family member is being enticed to Ireland by the claim, that having a UK "Residence Permit with indefinite leave to remain" (but not a UK passport), he does not need any type of visa either to stay or work there. Is this correct?

No, not correct. UK ILR is only relevant to the UK, not to any other EU country.

Thanks for the quick reply.

He is travelling to Ireland with his Irish partner and their baby (born in the UK but with no passport) via Northern Ireland.-what sanctions will he come across when in Ireland?

1. The baby needs a passport to travel across country borders. Not having one is irresponsible. A British Passport for a child can be done very quickly.

2. He is not allowed to work and reside in Ireland if he does not have the permission to do so. As the spouse of an Irish citizen, there is also an income requirement the Irish spouse has to meet.

Thank you for the link, and by the way he is not married.

More difficult for him then. He needs to apply from out of state before travelling to Ireland.

ISD will not accept applications for de facto partnership permission if you are present in Ireland on a ‘C’ Visitor Visa or on foot of the Irish Short Stay Visa Waiver Programme.

Thank's so much, you have shed light on an offer too good to be true.

What was the 'offer' and was it by an 'agent' or an existing company (no names)??

Also really important to remember that the UK and Rep of Ireland share immigration information. So if he jumped at something that isn't true and ended up with a dodgy immigration situation in Ireland, the UK will know about it if he then returns and applies for British Citizenship.
