Best Date for Application

Hello Team,

I hope you are all well.

I am currently on Tier 2 Visa, and I am applying for ILR in Nov 2022.

My wife has joined me after 6 months, which would mean that she will apply for ILR in June 2023.

Now, regarding the Citizenship application (if all goes well).

1. I understand that I need to wait for 12 months of the date I was granted the ILR since I am not a spouse of a British citizen, correct?

2. Should my wife wait for 12 months since she will obtain her ILR on PBS route? Or she can apply immediately when she gets her ILR given that I have my citizenship at the time?

3. As dependent, would she require English Test ?

3. For naturalisation there is no concept of "dependent" application - applicants apply in their own right, if they qualify, and are assessed as such. If she didn't have to provide an English test for ILR she'll need to take the test for naturalisation.
1. Correct
2. If you are British by the time your wife receives ILR, she can apply immediately, if she qualifies, including the three year residency requirement. Visa route is not relevant for naturalisation.

1. the 12 months starts from the ILR grant date, not the application date. Correct?

2. She will by then, as she will be in the UK for more than 5 years by then.

3. However, if she took both the English Test (IELTS for UKVI), and the Life in the UK for ILR, she won't be required to re-take them for naturalisation. Right?

Correct.

Spouse of British citizen is based on 3 years residence.
