british citizenship application after separation from spouse

Post by krishsat1990 » Tue Aug 10, 2021 11:13 am

I finished my 2 sets of 2.5 years after marriage to my spouse and acquired my ILR in 2018. Although I was immediately eligible for applying for British Citizenship (my spouse is British), I chose not to do it back then. I have an American passport.

If I'm separated from my spouse (We are still married but are going through a period apart), and thus live separately, can I still qualify for British Citizenship? I will be applying under the category of having finished more than 12 months after gaining ILR, so do I still need to include the details of my spouse and provide my marriage certificate whilst applying for citizenship?

I also thought British Citizenship you don't need to provide proof of work or funds - but the application asks for occupation etc. Please can someone clarify?

Your spouse is not a sponsor for naturalisation, there's no such thing. Yes you can apply on the 5 years basis. You still have to disclose you are married and provide details, but not the marriage certificate etc.

I also thought British Citizenship you don't need to provide proof of work or funds - but the application asks for occupation etc. Please can someone clarify? You do not have to prove work or earnings. You prove residency. As you are under UK ILR you just provide your passport(s) for the qualifying period, showing stamps in/out.

Thank you for your responses. Will the living separately be a barrier at all, in your opinion?

I believe the point is academic as you now qualify under section 6(1), however even if you were not living together as a couple, but were simply married, you would have qualified under section 6(2), as that provision does not require subsisting relationship, suffices that you are married.
