Unemployed/Redundant - proving I have not been outside of the country for more than 90 days

Post by neti1988 » Sat Apr 25, 2020 10:55 am

Hi,

I have been living in UK for over 10 years, was made redundant last month with 21st of April being last day of employment.
After having ILR for literally 1 year finally I am able to apply for the naturalisation.

I am now concerned that while I lost my job I may be questioned for the prove of being in the UK for 90 days prior to my application.
On the first day of unemployment I did apply for the Universal Credit and Job Seeker Allowance in order to gain any proof of living in UK, however I am afraid that now with Covid-19 it will take a very long time to get a reply and confirmation for the benefits and therefore I may not have a proof of being in the UK.
In the past 12 month I have only been away on holidays which was around 20 days in total.

Can you please tell me whether my unemployment may cause a problem to my application?

Also can my bank statement with spendings made in UK after my unemployment and prior to the application can be considered as an evidence?

Employment is NOT mandatory for citizenship.

Also if you got ilr through the UK immigration visa route, you are NOT required to submit all sorts of evidence of being in employment and proving absence etc.

You are only required to submit your passports to prove residence.

But of course I still have to be in the country 90 day before the application?
Does it mean if I already have a settlement status ILR naturalisation process does not require as many evidences as it is stated on the AN application form?

Is there any topic or website so I could refer to how the process is different for ILR holders?

Thank you

Naturalisation is not an immigration application. It has less documents required than whatever ilr route you came on. It also has completely different rules/laws than ilr.

Read the AN guidance notes. It tells you what is required!! The process is the SAME for everyone applying for citizenship. Everyone has to hold ilr or settled status to qualify for Naturalization on form AN.

Got it.

Can you help my to clarify this :if on the day of the application lets say I was unemployed for over 3 months, not having a proof of income such as payslips. How do I prove that I have been for that time in UK?

There is NO requirement to provide proof of employment or earnings if you got ILR through the UK immigration visa route (ie NOT the EU rules route). You are ONLY required to submit your passport(s) covering the 5 years preceding the date of application.
