Certificate of Entitlement

Post by ssaw85 » Mon May 06, 2024 12:12 pm

Dear Sir / Madam,
I am an Indian passport holder with ILR whereas my wife recently acquired her British citizenship through Naturalization in Dec 2023.
My wife had travelled to India on e-visa and have delivered our baby in April, 2024. I am confused about which route to opt for bring our baby to UK:
- Apply for British passport - Based on responses on the forum, it is taking over 6 months. My wife cant stay in India beyond July due to 180 days restriction.
- Applying for Indian passport and then COE/ROA - time for Indian Passport - 3 to 4 weeks + COE/ROA timeline of 12 weeks. This could not let my wife stay beyond July due to 180 days restriction.

Can you advise on which other visa, can our baby travel to UK and whether I can apply for her COE from UK?

Thank you.

Assuming the 180 days you refer to relates to her time limit to stay in India and nothing to do with absence from the UK.
- Applying for Indian passport and then COE/ROA - time for Indian Passport - 3 to 4 weeks + COE/ROA timeline of 12 weeks. This could not let my wife stay beyond July due to 180 days restriction.
This is your only option as is quicker but can still take a few weeks.
Can you advise on which other visa, can our baby travel to UK and whether I can apply for her COE from UK?
Your wife has to apply for the child in India. It is a vignette glued into the passport. There is no other visa the child can apply for as the child is automatically British by Descent.

Your other issue is whether you can apply for the childs Indian passport due to your wife becoming British.

British Passport application for child from India

Post by ssaw85 » Mon May 06, 2024 8:51 pm

Hello all,
Can anyone guide me through the process of passport application for my child born in India?

Background:
I currently hold Indian Passport with ILR and my wife holds a british passport (Naturalised). She is currently in India on 180 days visa valid until end of August. Our daughter was born in April in India. We wish to apply for her British passport so as to bring her to UK.

Can anyone guide me with the process? I am pretty much overwhelmed by the process as I was previously considering the COE/ROA route but due to complications in our Indian documents has made indian passport application very cumbersome.

Any advice would be really appreciated!

Thank you

Thank you so much!

We had our Indian passport appointment today. Due to complications in the documents required, the application was rejected. Hence, I am also considering the British passport route :(

Passports from abroad can take a very long time and sometimes longer than 6 months. Your child may not be able to come to the UK with your wife if she has a time limit to respect while staying in India.

British Passport application for child with Certificate of Entitlement

Post by ssaw85 » Thu Sep 05, 2024 4:32 pm

Hi,
I wish to seek advice from you on the route to apply for British passport for my daughter.

Background:
My daughter was born in India and holds Indian Passport alongwith Certificate of Entitlement for Right to Abode. This was achieved through my wife holding British Passport at the time of my daughter's birth. I had to opt for this route as my wife couldnt stay beyond her e-visa and the processing time for the British passport was well over 8 months at the time.

My wife and daughter are back in the UK and I am now intending to apply for my daughter's British passport. Can you advise on how do I approach this?

Thank you.

How did your wife become a British citizen?
If she naturalised then her certificate would support child’s passport application.

You will need you wife's certificate of naturalisation, together with full birth certificate, and daughter's Indian passport. You can apply here https://www.passport.service.gov.uk/filter/overseas
