Hey Eveyrone!

Hope you're all well. My first spouse visa is about to expire on 19th Feb 2024 and applying 28 days before meant the earliest I could apply was 23rd Jan 2024.

I was under the impression that it's the appointment date that matters - which isn't the case (stupid mistake i know).

So, I now applied 9 days earlier than I should have and my appointment date is on the 19th Feb. I have heard applying early can cause issues with ILR application because of not having lived for 60 months.

For context, I was granted the visa on 17th May 2021 and entered the country on 26th June 2021 (approx 40 days later thanks to covid).

Online date calculator gave this result:

From and including: Saturday, 26 June 2021 (entry date)
To and including: Tuesday, 16 January 2024 (online application for extension)

Result: 935 days
Or 2 years, 6 months, 22 days including the end date.
Or 30 months, 22 days including the end date.

I have been out of the country few times as well but it has not been more than 180 days in a 12 month period starting from 26th June 2021.

Should I withdraw the existing application and re-apply? In doing so should I also cancel my appointment considering I'll just reapply and can use the same date?

Appreciate any advice even if that's helpful for the ILR application in future!

Its fine, not n issue. You can apply 28 days before reaching 30 months from date of entry.

There ia no 180 day absence limit for spouse visa holders either.

@CR001 Hope you're well. Just wanted to check if we still need to provide the copies of previous passports and immigration stamps on other pages like we did for the first visa application?

Just wanted to update you that I had my biometrics on 19th Feb and today (21st Feb), I got an email that my application has been successful. Thank you for your help!

Also, in general, when would be the soonest I can apply for ILR considering I entered the country on 26 Jun 2021? I reckon it should be any time after 26 Jun 2026 or perhaps 28 days before i.e. 29 May 2026?

28days before completing 5years in UK counting from date of first entry on spouse visa
