I need your help going through a few dates with me
Here is my timeline -
Date spouse visa granted - 10th Jan 2014 - 10th July 2016
Date applied for an extension FLRM 6th May 2016 (early I know. It was in an in person appointment so I received confirmation on the day visa was granted without any issues although I did apply before the 28 days)
Extension from 06th May 2016 until 3rd Dec 2018.
I sadly applied for my SET M on 16th November 2018 and got refused as it said I had not competed the 60 months. I applied 27 days earlier. I had valid leave until the 3rd of December.
I applied for FLRM on the 20th November 2018 after this which was granted on the 11th January 2019.
My current visa expires is August 2021 and now I am well over the 60 months.
My question is do I qualify to apply for the SETM now. I am over 60 months but the uncertainty arises from the period when I applied for FLRM on the 20th November my BRP expired on the 3rd December and the grant letter was issued on the 11th January. I applied while I still had leave to remain so should be fine but just wanted to check. I’m looking for apply for SETM in the next few days.

If you weren't put on 10 years of route on set M refusal then you can apply set M after completing 5 years minus 28 days from the date of entering or switching (if from inside of UK)

I’m writing a cover letter and I want to explain the situation of the two FLRMs followed by the SETM which was refused as I applied earlier than 60 months and then the FLRM extension again which expires in August 2021.
Could you help me calculate the number of months I have been in this category for?
The period from when my BRP expired from 3/12/2018. Then receiving a positive outcome on 19/01/2019.. how should I treat this period? Should it be calculated as part of the 60months as well as I applied before my LTR expired?

Yes the time consumed over the processing of application would be considered same as if you were holding the visa by virtue of section 3C. Your baseline would be the date when you had entered the UK and from that point onward once you will complete your 5 years minus 28 days then can proceed to SET M.
