Carer's Allowance Spouse Visa

Post by tayloragreen11 » Wed Jun 26, 2019 5:40 am

Hi,

My husband is a full-time carer for his mom and receives Carer's Allowance. With this, I know we are exempt from the financial requirement of £18,600, however, must meet adequate maintenance.

This is where I am confused. Due to his full-time care, he is not currently employed, yet he receives monthly financial support from family and various business ventures, bringing in much more than the required minimum of £114.65 per week. Yet, I have read the rules which state that 'third party support' is not allowed. Does his situation qualify under this? If so, what do you suggest we do to prove he can adequately take care of me?

Thanks in advance!

He will only be exempted from financial requirement if he is actually claiming these allowances/benefits not his mom.

Yes, he receives the carer's allowance weekly. However, he is unable to work, but does receive money from family and from other means. Will this be enough to show adequate maintenance if he is bringing in more than the minimum £114.65 a week from multiple sources? Appendix FM states that third party support is not included, which is what is worrying me..

It should be from benefit authorities not from friends/family.
