Chance of new employment // tier 2 process

I am still with my current employer on tier 2 but have signed an offer with a new company and they are doing labor market test at the moment. Would appreciate any thoughts on the following:

- What are the key steps after labor test is complete (both on me and on the company) to apply for a new BRP or visa?

- Do I need to stay in the country and do in person appointments for the new visa or BRP during the application period?

- When would I be able to travel? Once I submitted the application?

- How long does it take to get a new BRP? Time to process based on types of appointments (premium, priority etc?)

- Planning to quit once labor test is done, is this sensible?

Mistake number 1. You should only be offered the job AFTER the full and proper RLMT has been completed.

The employer has to assign a UCoS and you have to apply for the visa.
- Do I need to stay in the country and do in person appointments for the new visa or BRP during the application period?

You can apply within the UK yes. There is no 'in person same day decision' service anymore. You have standard service or super priority.
- When would I be able to travel? Once I submitted the application?
No. If you travel out of the UK, your application will be considered withdrawn.
- How long does it take to get a new BRP? Time to process based on types of appointments (premium, priority etc?)
Depends on the service you choose when applying online and through UKCVAS. Once approved, BRP takes up to 10 days to be delivered.
- Planning to quit once labor test is done, is this sensible?
You should resign once you have your new visa. You risk a visa refusal as you appear to be 'pre-selected' and signed and offer BEFORE the RLMT was completed.

Hello,

thank you for the reply very helpful.

Just to be clear -

Signed an email offer terms - not full length contract with details on everything, which would come after the labor test.


How long would it take for the employer to give out a Cos and once I received that, how long would it take to make appointment, get finger prints done and then eventually receive the BRP? Assume that I would get the super priority service - fastest option

You were offered the job BEFORE the RLMT process, so the RLMT is therefore not a fair process for all.

Once UCoS is assigned and you apply, it shouldn't take more than a couple of weeks till BRP delivery. Assuming HO don't scrutinise things and ask for evidence of all applicants from the RLMT and reason why you were 'selected'.

Just to make it clear - even if you get a visa and at a subsequent visit it is established that the RLMT was not undertaken appropriately then you run the risk of your Sponsor losing their licence and your visa being curtailed.

Acceptance of the job offer in any form prior to the completion of a RLMT is pre-selection and as you are aware you are complicit in the failure. You under those circumstances can be summarily curtailed without notice, just saying.
