Child one parent settled one on main Tier 2

Hello everyone, I salute your helpful forum.
My query is in regards to status of my child born in uk.
I changed from dependant to tier 2 when my marriage was in difficulty. My ex husband went on to get settlement. I had a child with him after all this but he has abandoned his child COMPLETELY.
How can I apply for his passport without fathers details? What is status? Can I apply for his passport with a cover letter?
I would really appreciate your help.

How old is your child now ?
Do you still have the Birth Certificate with the father's details ?
Do you have any immigration related documents of the father - a reference number, for example.
Does the child have any immigration document now ? As a dependant ?

Hello, many thanks. I do not have any immigration documents for dad . I have baby’sfull birth certificate. We went together to register birth. My little boy is 3 in Oct.
I have my old dependant vignette in my passport. Baby has never been out of the country and no immigration documents.

I am not an expert on this, but I can't see anything that prevents you from applying for our child's citizenship. But without any information about the Dad's settled status, the onus is on the HO to verify that. Something they don't need to do. But, as you suggested, submit a cover letter, provide as much information about your dependant visa and so on, so the link can be made. HO does have considerable discretion here, so it is quite possible it will be approved.

:cry: passport application has failed because I had no proof from dad. Is there any way to get this proof? I’m not sure what to do now.

If child was born before either parents were settled nor British, then child is not yet British.

If child’s father or mother had ILR at the time of child’s birth, then child is British.

Without proof that child was British, a British passport application would fail.

Did you apply for the passport or for citizenship registration (MN1) ?

Thank you guys. Child is British by birth but I can’t prove it. His father hates him because of child support. I applied for his passport directly. Status said contact us, so I called them today and they said I should try and get proof from ukvi . I’m expecting actual decision letter on Monday.
I don’t know how ukvi will give me info about another person.
I sent my old dependant visa
Marriage and divorce cert
Birth certificate
Child maintenance letters.
I have absolutely no chance of getting it from him.

That is tough.

Get some legal advice - it should be possible to force the father to provide the documents legally for the welfare of the child.

:shock: A while back I asked how I can get passport for my son who was born to dad settled and me on Tier 2 after we divorced. Dad refuses to provide proof of this and passport application failed.
I got settled a few months back and submitted an application to register my son at JCAP. Today I got a reply to say he’s already a citizen and they will refund my fee. Will he get his passport application approved anyway?
I’m tired of this and seriously thinking of going to the press. My son has not seen his grandparents 3 years now since he was born.

Yes, worth going to the press. This is not just a matter of refunding fees - the amount of stress is being ignored.
If HO says he is a citizen, of course they have to issue a passport.

Unfortunately, sometimes HMPO and HO disagree with each other.

Probably highlighted by the HMPO's non-acceptance of HO's Confirmation of British nationality status!

Yes, I can’t apply NS as passport office will not accept that. My letter from HO also said I can’t use it as supporting document for passport application.
I’ve contacted my MP who seems ready to help.
I’m hesitating now to contact press for child’s privacy. I just want to give him the world.
I’m grateful that these are the problems I’m encountering as an immigrant because it could be worse.

HO must presumably have the data of child's father's status when child was born.

Today I got my son’s passport in the mail. I can finally visit grandma! I started complaint procedure via resolver and also asked MP for help . I explained why evidence will never be produced honestly.
