Hi,

I would like the experts to help me out here with a question. If my child was born at a time when my ILR application was "in process", meaning that I had applied for ILR before the child was born, what will be the immigration status of my new born child if my application was accepted and I was granted ILR after the child was born? Will he be a British Citizen and I would just have to apply for registration or is that not required at all? If not, do I have to apply for Naturalization for my child directly or do I have to first get ILR for him and then Naturalization with my Naturalization application? I have tried reading all forms and guidance notes but this is a confusing scenario and I could not get an exact answer from there.

If the child is born in the UK before you are granted ILR, once you have ILR you can register the child as British Citizen on form MN1 under section 1(3) of the nationality act, as an entitlement. This can be done once you have the birth certificate from the registry office.

Once you received the registration certificate from UKBA, apply for a passport, forms available from Post Office.

Hi,

Many thanks for your reply, so just to confirm, it will totally depend on the date a decision is taken on your IRL application (i.e. date mentioned on your BRP/Letter etc which states when was ILR genated/approved) and the date the child was born on. If the child was born after this date, then we could apply for Passport directly, otherwise, we would have to use MN1 form as you confirmed above and once that registration is done, then we could go for the passport. Can you confirm if I am correct?
