Child born in India to ILR parents

Post by desperate4ilr » Mon Oct 28, 2019 2:08 pm

Hi,

My brother and sister in law both got their ILRs and have not yet applied for British citizenship. Due to health reason my sister in law went to India for delivery and she has a baby boy now. Now we are confused as to which visa we should apply for the child who is born in India. He is not registered in India for Indian passport yet.

Any help will be much appreciated.
Thanks

The child needs a passport and then has to apply for a child Settlement visa, costs £1523 plus IHS.

https://www.gov.uk/uk-family-visa/child

Had the child been born in the UK, the child would have been automatically British and could have applied for a British passport directly.

Thanks so much for your response. Yes if child would have been born in the U.K. it would have been much easier. Straight British citizenship. Is this an online application?

So is it the “apply separately” option from the link?

Just to make it clear that they are planning to get child to the U.K. for first time. So child settlement visa is the one they should go for?

It is an online application yes applying on their own, but you must have the passport first otherwise you won't be able to apply.

This is the link.

https://visas-immigration.service.gov.u ... 1572271782

And then you also need to complete Appendix 1

Yes, there is no other visa you can apply for.
