Child dependent visa

Post by jainp » Sun Mar 20, 2022 3:37 pm

Hi Experts,

Background:
I have recently got the ILR and when I received the ILR, my wife and child was outside the UK. Now I am planning to bring them to the UK. My wife have already got the Tier 2 general dependent visa and we couldn't apply for ILR because she hasn't completed 5 years on her dependent visa because she was on other type of visa and later switch to dependent.

Queries:

* Since my wife has tier 2 dependent visa, I think, my wife can continue using the same to enter in the UK, is my understanding correct ?
* I need to apply for my 1 year old child who was born in UK and then came back to India and now I want to apply for his Visa. I am reading the guidelines here https://www.gov.uk/uk-family-visa/child and seems like I need to follow the guideline for applying separately as myself and my wife have got the visa. I found this form: https://visas-immigration.service.gov.u ... ype/funnel

is it the right form to fill ?

Child applies for a PBS dependent visa, same visa category as what your wife has.

SW 30.1. The applicant must be the child of a parent (P) where one of the following applies:
(a) P has permission on the Skilled Worker route; or
(b) P is, at the same time, applying for (and is granted) entry clearance or permission on the Skilled Worker route; or
(c) P is settled or has become a British citizen, providing P had permission on the Skilled Worker route when they settled and the applicant had permission as P’s child at that time.
Does (c) apply here? It seems the child did not apply for dependant visa before leaving UK and therefore did not have permission as P’s child when P was settled?

Or simply the child can rely on (a) because of his mother and SW Dep is included within SW route?

I have been reading for the last two hours and got the understanding that I need to fill the AppendixFM form : https://visas-immigration.service.gov.uk/visa-type

can you verify that please ?

No, you need to apply for a skilled worker dependent visa, same rules as the mother's visa.

I am coming to the UK Tier 2 skill Worker VISA. My husband is not travelling with me as he has to take care of his aged parents and due to his professional commitments. I am planning to apply for my child's visa as a dependent. Can I please know the procedure for taking my baby along with me to the UK without my husband travelling along with us? Can a consent letter from the husband suffice? If so do can I get the format to be followed?
