Child 7 years ILR under new Rules

Dear Sirs,

Thanks for the advice that helps thousands. I have few questions to ask whether my immigration background is as currently waiting for the Asylum screening interview as an overstayers followed by student visa, PSW visa, Entrepreneurs visa, 10 years ILR application (refused 2018) have been living since 2008. My elder son is going to be 7 years this month. Thanks for your patience.

** I am getting ready to apply ILR application this month for my elder son who will be 7 years this 25th December 2022. How long it can be taken for the results as current situation?
** I am also planning to apply for ourselves separately in Feb 2023 as a parents of 7 years ILR qualified child. To be honest, I am thinking this way to save our application processing time and to avoid Asylum long process? Should I continue this application and Asylum application at the same time? How far is it possible to get our Parents dependent visa as we are currently in Asylum waiting for screening interview ( and overstayers since 2018) after have been refused our 10 years ILR application?

Please reply me and it will really help me to get the future decision. Thanks again for giving me your valuable time.

What visa category does the child currently hold?

He doesn't have currently any UK visas.

The child needs to hold a qualifying visa (private life or similar) to qualify for ILR under the new rules.

What happened to the child Tier 1 Dependent visa they had previously??

Thanks for your quick reply. Going back to the background,

I had Valid entrepreneurs visa until 2016 March. My entrepreneurs extension visa application was refused in 2016 when this baby was just 4 months. After refused, I applied another Entrepreneur extinction visa within 14 days of refusal. But this application was pending about two years, Then I have applied for 10 years ILR in 2018 while the Entrepreneur decision was pending. But Unfortunately, HO have refused ILR in 2018. Then, I have won 1st tribunal, lost upper tribunal and court of appeal according to the landmark cases of Hoque & Others Vs Home Office in 2021. Then I have applied for Asylum as whole family which one is currently waiting for the screen interview. So, He never had visa. But he born here and going to be 7 years this month. Thanks.
