Children Naturalisation Queries

Post by Archimedes » Sun Sep 18, 2022 8:36 pm

Hi,

Apologies if this needs to be in an existing thread. I have gone through the threads on this board and couldn't find one suitable. Hence posting it as a new thread.

Situation:

1. I have just got my citizenship certificate. (Tier 2 General 5 years - ILR 1 year route)
2. My children got their ILR in June this year (2022). They were both born outside the UK before we moved to the UK. Then they spent five years here on Tier 2 dependent visa and got their ILR. Ages: 13 and 9 as of today.
3. My wife also got the ILR at the same time (June 2022).

The normal route is to wait for one year on ILR and apply for citizenship. However, since I have already got the citizenship, can I apply immediately for the naturalisation of my children, or do I have to wait for them to complete their one year on ILR (June 2023)? This is not clear at the moment because I acquired my citizenship after they received their ILR.

Can someone please clarify this?

Thanks a bunch in advance.

Wife and children can apply now.

Note, children are registered as british. Only adults are naturalised.

Thanks for the quick response. I am confused as to which option to select in the MN1 form. Here are the options given on the gov.uk website. None of them apply to me (other than the last option - "Other"). I am now a naturalized citizen of the UK. Applying for my children. Any guidance here?

The "One of both of your parents applying for British Citizenship" is not the correct one as I have already applied and got the citizenship.
  • Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born

Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British Overseas territory

You were born on or after 13 January 2010 and your parent was serving in the UK armed forces

You were adopted abroad by British citizen parents

You were born before 1 July 2006 to a British father and your parents were not married

One or both of your parents is applying for British citizenship

Other - apply at the discretion of the Home Secretary

Is your wife applying at the same time? In this case, the "One of both of your parents applying for British Citizenship" would apply and she would make the application in her name?

Which form? MN1 options are not suitable for this case. (Refer to the list posted above). Not sure if MN1 is the right form in this case.

You can only use form MN1 for your children.

Select the "Other" option, the last one as that is the only one applicable to your children.

Unfortunately, the "other" option is taking me down a wrong route. It asks for grandparents' details "who are passing down citizenship". In my case, the grandparents have no connection to the UK whatsoever.

It has not asked if my wife has ILR. Just about my nationality and then my nationality when the child was born.

Not sure if this is the correct path.
