US citizen applying for UK Spouse Visa from Ireland

Post by anselpub » Wed Mar 27, 2019 2:58 pm

I am an American citizen eloping to Denmark with my UK fiance in June. Rather than return to the US to apply for a spouse visa, would it be possible for me go to the Republic of Ireland and apply from there? I want to be close to the UK so my fiance could visit occasionally while we wait for a decision, but if approval takes more than the ROI 90-day tourist visa, I would not have my passport to move to another country to wait.

First question is: Can I apply from a country other that my country of residence? I can't seem to find an answer on the UK immigration site other than "can't apply from the UK."

Second: Is it a bad idea to risk being an overstayer if the decision takes more than 90 days.

Thanks in advance for any advice or ideas/risks I haven't thought of.

1. You must apply from a country where you have legal residence, ie. not as a tourist/visitor. You will need to return to the US to apply from there.

2. Yes, it is always a bad idea.
