Citizenship for the child born in UK

Post by Ashwin G » Thu Jan 02, 2014 12:17 pm

Hi,
I have a query regarding the citizenship application for my daughter - she was born in UK in March 2013, and now I have completed 5 years and going ahead with the ILR application, My wife will be eligible for ILR in July 2014

My questions are -

1) Can I apply for UK citizenship of my daugher after my ILR alone (with my wife sill on tier 1 but about to complete 5 years) - May be under Section 1(3) or 3(1) on the following link -

http://www.ukba.homeoffice.gov.uk/briti ... /borninuk/

2) If not, then can I wait till July 2014 for my wife to get the ILR and till then not apply for citizenship for my daughter, till then can I keep her without any Visa in UK

3) If nothing else, and I need to apply for Visa instead of citizenship for my daughter, should I submit the two applications a) my ILR b) my daughter's Tier 1 dependent (or is it ILR dependent), in such a case what would be the duration of her Visa, considering my tier 1 is expiring in 12 months ?

Many thanks in advance for your help

Once you have received your ILR and BRP, you can register your daughter on MN1 under section 1(3) as she is entitled to register.

Read the children section in the FAQs, link below

As she was born in the UK, there will be no issue if she does not have a visa and if you are not planning to travel. Her registration is an entitlement/right and not the 'at the discretion' type.

Hi

I am in the same situation. I will be getting ILR in Feb and planning to apply for my UK born daughters registration/citizenship after my ILR. From above threads it is clear that I can apply for her citizenship directly without applying for her ILR because she is born here.

My question is: on MN1 form second question is when child has acquired ILR?
Should I leave that blank or mentioned my ILR date there. Please guide. Thanks.

Regards

Amber has answered your question already in your other post. Leave it blank.
