Hi,

I'm on tier 2 general visa and I had applied for 30 hrs child care last December when my daughter turned 3. I had checked the eligibility criteria that time and I got the code for availing 30 hrs child care.

Now I learned that 30 hrs child care is not applicable for parents from outside eea who are not eligible for recourse to public funds. So certainly they have changed the eligibility criteria in last few months.
I'll be cancelling 30 hrs child care benefit for my daughter now. Do I have to pay back anything to hmrc as I have accessed the public funds.

I wanted to check as I don't want any issues when I apply for ILR next year. Please advise.

No, it was not changed "in the last few months". 30 hours is only available to settled persons or British.

These questions have been posted for a few years already. If neither parent is settled, you don't qualify for the 30 hours child care.
