Conditions that Invalidate/expires ILR

Post by PinkFloyd » Thu Nov 17, 2011 9:52 pm

Hello People,

This might be jumping the gun a bit, but I would like a little bit more information of ILR before I apply for one next year. The conventional wisdom is that it frees one from continuous renewal of permissions to live and work. But going through the UKBA website, it says that ILR will be revoked if one stays out of the country for 2years or more after getting the ILR.

There are no further explanations that I could find. I have these nagging questions and it will be great if you can help me with them.
1. Is this a minimum period that one stays out of the country at a *single stretch* i.e. if one is the UK for a month every 2 years, he can keep his ILR valid.
2. Does the absence means a physical absence... If I have my company based in the UK, paying taxes and NI but I myself operate out of the country, will that count as an absence.

As with anything, the letter of the law is quite different from the experience, so I am counting on people who know.

Cheers!

See:
1. returning residents
2. Section 3 - Returning residents and Annex K.
3. SET09 - Returning residents

You may get away with a few visits, but not for long.
"Absence (of a human being) from UK" means exactly that - absence.
Life isn't fair, but you can be!

Thanks... That was lightining fast response.

I will get down and dissect the finer points of returing residents vs visitor.
