Cooling off period inside UK

Hi All,

I am currently on a "Tier 2" visa and planning to switch to "Tier 2 dependent" visa and stay in the UK and continue working. If in the near future (lets say 6 months time), I decide to switch back to "Tier 2", does the cooling off period apply to me or I can switch back to "Tier 2" without waiting for 12 months?

Replies are so much appreciated. That would be great if you could also refer me to the right section on the Tier 2 policy.

What 'Tier 2 Visa' are you on?? There is more than one kind.

You will have to wait a full 12 months on PBS Dependent visa before you can apply for a Tier 2 General visa, which you must apply for from your home country.

Thanks for the quick reply.

I am on Tier 2 General.

So even if I stay in the UK, I still have to wait 12 Months and Make the switching from outside the UK?

Yes to both. The 12 months will start from the date the PBS dep visa is granted/issued.

Simpler to find a new sponsor as then your residence towards ILR is not interrupted either.
