Cooling-off period Tier 2 General

Hi,
I recently left UK because of some family issues. I had Tier 2 General leave to remain permit. My leave to remain expires in 2017. Now my family problem has been sorted and I want to go back to UK and start a job. I am not quite sure about the Cooling-off period. Is it also applicable to Tier 2 General?

Yes. You will be subject to 12-month cool-off from the day you left UK before you can apply for another T2 G application.

Thanks for your reply. But what if the sponsor has not notified UKBA about my resignation?

What was your employment status in UK while you were back in your home country?

If you resigned, your employer have to report it to UKVI. It's one of their responsibility as A-rated sponsor. Otherwise, they risk loosing their license.

Hi today I have received an email from home office about curtailment of my visa. Now my Tier 2 visa is valid until December 2015.I resigned from my job and also have left UK. My questions are: 1. Will this curtailment allow me to enter and exit UK multiple times until December? 2. I want to go back to UK now and get an UNRESTRICTED COS from my past employer or a new employer to get a new Tier 2 General visa, is it possible to do that with the remaining visa duration?

It is unlikely that you will be allowed to re-enter the UK as your visa has, in effect, been cancelled. There was recently a post of someone trying to do exactly what you want to do and was sent back to her home country.

You would have been better off staying in the UK to sort out a new sponsor.
