CoS declined causing employee to miss visa expiry date

Post by CAUK » Fri Sep 01, 2023 10:50 am

If one wants to extend their Work visa and requested a CoS before the expiry date. However, there is trouble acquiring the CoS until the expiry date has passed. Can one still apply for an extension? Or does it require a completely new skilled worker visa application.

It depends when the previous visa expired. You normally cannot apply for an extension if you are an overstayer with no valid visa. If this was anticipated, the visa holder should have left the UK by the last date of their visa validity and returned to their home country to apply again for a new skilled worker visa.

It is highly unusual and most unlikely that a request for additional undefined COS to be refused particularly to extend an existing period of leave. So there is something going on that suggests these reported circumstance is either not accurate or the Sponsor is under investigation or has even been suspended.

Has the OP checked to see if their sponsor in on the register?

Has the Sponsor stated the the reason for the COS?

Even in periods of suspension a COS will be issued to allow an existing skilled worker to apply to extend their visa. The visa application will not get processed until the after the suspension outcome is resolved though.

The employer received a message saying some information is missing, but upon double-checking, all info have been entered correctly. A follow up email has been sent to enquire about the situation but there has been no reply. A new application will be sent again today to see if it would make a difference.

The company is registered and is on the list of sponsors. The employer has a valid license for 5 years, so that shouldn't be an issue.

I believe the reason for the COS is filled in although I am not sure what the employer has written.

I guess the best option is just to keep filing application and contacting the support email.
