ILR for Tier 2 migrant with gap period

Post by runrun » Mon Dec 16, 2019 5:14 am

Dear members,

Please can anyone advise me? I am a Tier 2(General) migrant from Asia. I would like to know if I can apply for Indefinite Leave to Remain after 5 years stay in the future.

My employment history is below.
1st Tier 2(general) sponsor : April 2016 - March 2019
2nd Tier 2(general) sponsor : April 2019 - November 2019
Unemployed period : December 2019 - February 2020 (more than 60 days)
3rd Tier 2(general) sponsor : March 2020 -

My 2nd Tier 2 employment ended in November 2019 and I am in gap period(unemployed period) now.

I've just got a job offer from new company(3rd sponsor) and will start working for them from March 2020. The company is expecting to get Cos in early February 2020.

If I am eligible for the settlement, I would like to apply for ILR in April 2021. Please can anyone tell me if it is possible for me?

Thank you,

Yes. The 60 days limit rule was removed in 2018

Thank you Zimba! Can I ask additional questions?

Does it mean curtailment period was removed?

Do I expect to receive the curtailment letter from Home Office? My 2nd sponsor company has already informed Home Office my employment termination.

Is it lawful for me to leave UK temporarily for holiday before I start the job at 3rd sponsor company and come back by March 2020?

Thank you in advance.

No it does not. The curtailment process is completely separate to the previous 60 days employment gap rule. They are not the same thing.

Curtailment letters can take a few months to get sent.

You should not leave the UK until you have a new visa.

Curtailment notice for Tier 2 General visa holder

Post by runrun » Tue May 12, 2020 1:27 pm

Hi all,

Please can anybody advise?

I’ve left the previous job and lost tier 2 visa sponsor in March 2020. I expect to receive the notice from Home Office(curtailment letter) but still haven’t received it. It usually will be delivered within 60 days after leaving the job.

I am not sure when the deadline of my stay in the UK is. Please can you help?

Thank you.

Who told you that the letter is delivered within 60 days of leaving a job??? Curtailment letters can take several months to get sent out.
I am not sure when the deadline of my stay in the UK is.
It will be the date stated in the letter. Presumably HO have your correct address to send it to??

Topics merged, where you were advised of this already a couple of months ago!!
