Curtailment rules on Tier 2 visa - 3 month notice period

Post by violet_1133 » Tue Feb 05, 2019 4:23 pm

Hi,

I've seen a few posts mentioning this but I wanted to be in the clear.

My question is: In the case I give my 3 month notice and say my last day of employment is 31st May, is my employer going to notify the HO that this will be my last day immediately? If they do, is it possible that the HO sends me a letter to curtail my leave to 31st May and not to sometime in July (which would be 60 days after my letter arrives)?

Basically, I am worried that I will give my notice and somehow the curtailment letter arrives before my last day on the job, and I would end up with less than 60 days in the UK after my last day of employment.

Many thanks for clarifying!

Your employer is required to info HO within 10 days after your LAST date of employment, so after you have left.

No. Until you leave you are still employed by your sponsor. They can only notify HO once you have left the job. How long a curtailment letter takes to get sent varies. It can take a few weeks or a few months.

Perhaps you are overthinking.

When do you plan to submit your EEA EFM application??
