Date of documents

Hello,

Though there has been some threads and discussion on driving offences and ILR, please could I ask whether my specific circumstances will affect decision of ILR of my husband.

I am a tier 2 visa general migrant and me and both my husband and my child will be eligible to apply for ILR now.

We were filling the online form where in the conviction declaration page, we were stuck.
My husband had a speed awareness course in July 2017 which I would believe shouldnt matter as its already 24 months sine then.

But in Nov 2019 he had received a NIP for traffic light violation but again has been offered a Driving awareness course instead of fixed penalty points/fine.The course has been booked.

We have done a recent license summary check after this incident before renewing car insurance and his license summary doesnt show any endorsements/points.

Thus now we are confused ---
1. If We should declare the driving courses though none of them actually matches the Set O form conviction list.
2. If we do declare (and if that is unnecessary) whether he will end up failing to meet the ILR eligibility.
3. If we dont declare will it be considered as "non disclosure of truth"
4. If he fails eligibility on above grounds, could my daughter be refused ilr along with him(its a huge sum of money we would lose then)?

What about the Driver awareness course named Whats Driving Us--thats for the traffic light.
Should we declare them anyways or that would just invite more problem!!

Please would some one advice if at all the Driving awareness courses needs to be declared. Do they fall into category of caution or warning.

There are so many different informations n some are scary.

I am sorry for coming back on this again. The lawyers advice to reveal the Driving offence courses as they advice that not disclosing it is a deception.
What I am not sure is why is it a deception, if attendance to course/waiting to attend a course is not considered a conviction.

Actually, if I am waiting for a course, does it mean, I am still not been cleared off the conviction!


This is so confusing as there are no specific advice on this.

We have repeated a million times that attending such a course is NOT A CONVICTION. This is NOT A COURT CONVICTION Your lawyers do not seem to know anything as only court CONVICTIONS must be declared. Even most traffic CONVICTIONS do not have any effect on ILR.

The Ilr documents like bank statement etc needs to be dated within 30 days of application date.
But what is application date?
The date we submit application online or is it the day we get an appointment for BRP (planning super premium).
I have collected documents from workplace, utility bills n bank statements--all dated recently because I want to submit application next week.
Now if the UKVCAS appt isn't available for weeks---
1. will my current document's validity expire?
Will I again have to gather new documents with fresh dates?

2.When we should upload documents? After online submission or just before UKVCAS appointment

Date if application is the date you submit and pay online. All your supporting documents must be dated on or before the date of application.

Bank statement and payslip not older than 28 days.

Now if the UKVCAS appt isn't available for weeks---
