Not hijack another posting in this regard.
Maybe someone can answer this question in terms of US citizenship.
My cousins who is British but leave in the US for three years in which time she gave birth to a little boy, who is American.
Will he be able to claim daul nationality British/American?

How did your cousin become a British Citizen? Was she born here, naturalised, by descent or otherwise than by descent?

I assume your question is about the child...
By birth the child is American, by descent is British.

Well we firstly need to find out if the child is indeed a dual national...

If the mother is British by descent, then according to the BIA guidelines the child can not be registered as a British Citizen automatically. Check here (pdf file): http://www.ind.homeoffice.gov.uk/docume ... iew=Binary

It states:
British citizens by descent cannot transmit their citizenship to children born
abroad except in the circumstances described in Chapter 4. British citizens
otherwise than by descent automatically transmit their citizenship to children born abroad.
I think the child, or the parent, would need to live or have lived in the UK or something, to qualify, but I'm not sure what the qualifying length would be.

Now...the US recognises dual (or more) nationality, as does the UK. So, if the child was eligible for British Citizenship in the future, then there is nothing stopping said child from being a US and UK citizen.

Can you clarify how the mother became British by descent? Did she apply for BC through her parents?

Sure my cousin was born outside the uk to of her British born Mother, hence British by decent!

Your cousin's child is therefore not a British citizen, assuming the father isn't British. If he was brought to live in the UK (before age 15) he could be registered as a British citizen after 3 years.
