ILR Online Application date

hi there,

my entry date is 11.04.2011 , and eligable to apply for ILR (Long term) on 14.03.2021.

My question should I make my application already today to get appointment for 14.03.2021 , or I can only make my online application from 14th of March ?

I saw one note below from different topic that confused me seems I can't make my application today.

"Make sure you calculate your 10 years from the date you entered the UK and NOT the date your first entry clearance was valid from. You can apply 28 days before your 10 years complete. You MUST be eligible on the date of the application and NOT on the date of bio metrics appointment. So only pay for the application if you are with in 28 days of your 10 years. So for example, if you entered the UK on 21 Sep 2009 you MUST only apply after 26 Aug (give or take)."

And also one more note I found from different source as follow;

Can I apply ILR before 28 days?
It is possible to submit your ILR application up to 28 days before the end of your qualifying period. If you apply earlier, you will not be eligible and your application is likely to be refused. You will however need to ensure you apply you should apply before the end of your permitted stay in the UK.

so based on this i assume my online application would be only on 14.03.2021 , is that correct?

Please also note my visa approval date : 04.04.2011 , and first entry to uk is 11.04.2021 , so i take first entry as basis to calculate 10 years.

Please do let me know if I could make application already or should i wait until March 14.

Your residence qualifying period for Set LR is from the date you entered the UK and not the initial visa issue date.

Apply online when you qualify.

Depature stamp missing on passport

hi there,

I found that one of the departure stamp to Istanbul airport from London is missing on my passport.

I have email confirmation of the purchased flight ticket from BA.,shall I provide this instead the stamp or should I do something special for ILR application?

Passports are not usually stamped when leaving the UK.

that is not correct, my passport never stamped when leaving the UK past 10 years, only when arrive to another country i have stamp available.

for the return to UK that is the case I have stamp for all entry to UK.

so repeating my question. shall I use flight confirmation email as proof to leave date of UK and upload in the system?

I also remember the reason i used e-gate when arrived to Istanbul to catch another domestic flight..

You stated your "departure Stampt to instanbul from London is missing". I responded to your statement.

So unclear what you are asking about a departure stamp from London to Istanbul! Try again.

There is no stamp available from UK officers when you leave the country.

Only stamps available when you arrive the depature point.

I used e-gate when arrived to new Istanbul Airport, means no stamp available on that journey on my passport to proof the leave date of UK , so shall I use flight confirmation email?

For the return to UK - I have no problem , stamp available for all entries.

That is not what you posted when you asked. You have not phrased your question correctly.

What you should have asked, to avoid cofusion, is that there is a missing stamp when arriving in instanbul from London.

Ukvi have their own records from the advance passenger information to know when you left the UK.

Simply list the absence/travel in the form.

hi,

I have a question related travel abroad. would it be possible to fly abroad after the desicion mail received?

so after receiving the card by agency they can post it to the county where we will fly to.

I know that its forbidden to fly before desicion that will cause withdrawn but not sure if i travel before receiving the card after the desicion letter.

The one I found is mentioning until the decision, could not find anything afterwards period.

The information as follow;

What will happen if I travel abroad while my immigration application is awaiting a decision?

If you travel abroad (outside the Common Travel Area (CTA) – which includes the UK, Republic of Ireland, Channel Islands and Isle of Man) before a decision is made on your application for leave to remain or settlement, the Home Office will treat your application as withdrawn.

The legal basis for treating a pending immigration application as withdrawn where the applicant travels overseas is set out at paragraph 34K of the Immigration Rules, which states as follows:

34K. Where proof of identity provided under paragraph 34(5) has been returned to the applicant pending a decision on their application for leave to remain and the applicant travels outside the common travel area their application for leave to remain shall, provided that it has not been determined, be treated as withdrawn on the date that the applicant left the common travel area.

Although it may be argued that paragraph 34K is not technically engaged because under the new application process the passport is not strictly ‘returned’ to the applicant, we regard such a position as inherently risky. The safer approach is to proceed on the basis that if you leave the Common Travel Area before the Home Office makes a decision on your immigration application, your application for further leave to remain or indefinite leave to remain will automatically be treated as withdrawn.

I know that but you were advised to stay until you have your BRP. If you do not want your BRP for now, then travel without it if you are sure that your application has been successful

Thanks Zimba , that is the case , we are planning to travel only after the approval letter has been issued by home office, not before that is not allowed.

Then the BRP card would send back to us where we will be in abroad later on as we plan to stay there around two months due to medical appointments.

One last question, the absence form departure dates should be filled based on the visa stamp date of arrival , or the flight departure date ? I am asking this because a have a few overnight flights such from 23:30-23:59 departure time , but normally actual departure time is after 00:00 , not to provide inaccurate information to home office.
