Dependant extension few weeks before ILR

Post by Ashish80 » Mon Nov 20, 2017 10:37 pm

Hi,

I got ILR last year via Tier 2 General route. My wife's dependant visa is valid till Feb 2018 and in another 70 days time she will be eligible for ILR. I want to know if it is a feasible option to:
1. Apply postal Tier 2 dependant extension few days before her visa expiry and when she is eligible then convert the application to ILR?
2. Is it safe? Are there any risks?
3. As she is working is it safe to continue working while her application is being decided upon and the current visa expires (we will apply before visa expiration).
4. Does anyone have any experience of anything similar or same?

Thanks for your response in advance.

Cheers,
Ashish

So she will qualify for ILR no sooner than within 28 days before the 5th anniversary of her date of entry to the UK.

PBS Dependent extensions are usually approved within 8 weeks and it will be a three year extension. You can vary to ILR if the application has not been decided by the time she qualifies for ILR.

If the application has been decided and approved, you will have to apply for ILR and pay the fees again. You won't get a refund of the fees you paid for the extension.

Thanks a lot for clarifying that CR001 :)
Is there a specific form/procedure for converting dependant application to ILR?

Cheers,
Ashish

See page 17 in link below. ILR form is Set(O) and she needs LIUK and English B1.
