Dependant Visa Extension or ILR for a baby born in UK

Post by T1EAccelerated » Mon Sep 28, 2015 6:29 pm

Hello Everyone.

Very new to the forum, and a question for which i could not find the precise answer, before posting a new query i tried looking for answers in existing forums.

I am in UK on T1 Entrepreneur Visa, already applied for my ILR on Accelerated Route, hopefully will get the ILR by end of Next Month.

But my visa and my dependants visa is getting expired in Jan 2016, i have 2 kids, one of them is 7 years old and other one is 2.

The 7 year old has been in UK from last 3 years, along with me, and the 2 Year old has been born in UK.

Once i receive my ILR, what route i have to take for my kids, do i have to apply for extension of their visa, or i can apply for ILR.

Both my kids have got indian passport, with a Tier 1 Dependant Visa, including the one born in UK, i had to travel with my family, so took a indian passport for her and got a visa stamped.

Expert opinion on the same would be appreciated.

Once you receive ILR, your UK born child is entitled to register as British citizen under section 1(3) of the nationality act using form MN1. Child does not need ILR.

For the 7 year old, not sure if ILR once you approved but likely a possibility. What is the visa status of the other parent?

Thanks for the information, so i do not need to extend the visa of my child after i have got the ILR.

Regarding the status of my wife, she will be extending her Tier 1 Entrepreneur Dependant visa for another 2 years.

It is only the UK born child you DO NOT need to extend visa for. The born abroad child and your wife will need to meet the requirements of their visas. When did they apply (the date) and enter (the date) the UK?

Thanks for your response.

My wife and other child entered UK in Oct 2012, and i am waiting to receive my ILR, after that i will be filing for their dependant visa extension.

The current visa for us all is valid upto Jan 2016.
