Dependent Child Visa for ILR parents

Post by nit2k » Wed Nov 19, 2014 10:38 am

Hi Experts, I recently got my ILR (From Tier 1), but my 1 year daughter born in UK(Indian Passport ), didn't have any UK visa . I am planing to travel to India next month. Just wondering which Visa she needs to travel back to UK ? Can I apply for Visitor Visa for her from India ? I am planing to apply for her British Passport once we will be back from India.

Only a British Citizen can apply for a British Passport, she is not British yet.

You will need to register as British her on form MN1 under section 1(3) which is an entitlement to register at cost of £669. After that you can apply for her passport once you receive the certificate.

She will need a visa to return. What visa does your spouse have?

If you are going to apply within the UK, which you can do in person :

https://www.gov.uk/remain-in-uk-family/eligibility

Or if applying from India :

https://www.gov.uk/join-family-in-uk/overview

I am sure I have read on the forum about visitor visa for children, but cannot seem to find the thread now. Perhaps one of the other mods can assist.

Why not just register and then apply for a British Passport, before child returns to the UK?

How long will child spend in India?
Do both while child is there.

Registration and subsequent British passport may be more straight forward, as registration is by entitlement.

A settlement (or visitor) visa is subject to refusal, if not all the relevant requirements are met.

Applying for a visa under 304 and 305 may be another option. However, there doesn't appear to be an appropriate form.
