EU dependent Visa: Brother is UK National

Hi,

My question is about EU dependent visa. My brother is living in UK and he is UK national. I lived with him in UK for three years and He sponsored my studies and lodging. Now I am in Pakistan. Can I apply for EU dependent visa to join my brother in UK as dependent family member?

I have heard that the UK national family member must come out of UK and apply the case in any other participating EU country. Please tell me how my brother can help me get that dependent visa?

What sort of evidences I will have to show for the application?

What is the normal processing time of the application?

Please any respected member answer my queries, I have been looking for answers without much success

He would need to move 'the centre of his life' to another EU country for 6-12 months, and that means everything (job, family, bank accounts, etc) to even attempt to sponsor you as an EEA FM. He cannot sponsor your for any type of dependent visa if he is living and working in the UK.

One very important thing to remember is that "extended family members" (everybody other than parents, spouses and children) are treated differently under EU law from "Family members" (only parents, spouses and children).

Extended family members do not get an automatic right to join their sponsor in another EEA country. Each national government has the right to specify rules for extended family members. The only condition is that it must be simpler than that for other non-EEA citizens.

So, your brother will need to research for the rules for extended family members in all EEA countries as these visas are granted under national law, not EEA law.
