Dependent visa situation when main applicant gets citizenship

Post by black1903eagle » Tue Jun 06, 2023 9:43 am

Hello,

I received my ILR a year ago after completing 5 year period with Tier2 visa and I'm now eligible for applying citizenship. My wife joined to me with a Tier2 dependent visa in 2018 but she had to stay outside of the UK for a long time and she will be eligible for applying ILR in 2026, she has dependent visa at the moment which is valid until July 2025. I have 3 questions about her visa situation:

1) If I apply for citizenship, should we do anything for my wife's visa or can she still use existing Tier2 dependent visa until it expires?
2) When I got the citizenship, does my wife have to wait for the application date for ILR or can she apply for citizenship earlier as my spouse?
3) Does my citizenship affect her next visa extension application which will occur in 2025 or can she still apply for extension as we did previously?

Thank you so much for your help.

1. Nothing to do. Her visa remains valid.

2. There is no shortcut. She qualifies for ilr when she meets all the requirements.

3. No it doesn't. She applies for a PBS dependent visa to get a 3 year extension as normal.

Thank you so much for your response. Can I also ask if she will need to wait 1 year after getting ILR for citizenship or in this case can she apply immediately as she will be resident for more than 3 years as spouse in the UK? Thanks again.

If you are British when she has ilr, she can apply for citizenship as soon as ilr is granted if she meets the 3 year requirements.
