Hello

Almost finished filling the form. Stumped on the document list. I understand we need to upload

1) Passport
2) B1 cert
3) 3 years of residence (p60 from 2022/23 to latest and council tax bills)
4) marriage certificate
5) spouse cert

There's a tick box against two referee declarations: I didn't see anywhere a template or document? I added the referees in relevant section in the form.

I see in AN01 PDF format section 5 page 21 and 22 there's info where they can sign.. is this needed? Can't see any posts on this.

Absolutely ignore me. The forms have come up as you go along the application. Just got confused as tick box appeared before the declaration section!

You only need your passport with stamps for proof of residence. Nothing else.

That's very interesting!

How odd not to submit swathes of documents this time around!

There are very minor motoring offences. 3 recorded in 2018 which are lapsed and one speeding offence last year.

Declared on form. We didn't keep hold of any PCNs but were appealed or paid in time and never been to court.

All requirements are met. Is a cover letter needed at all as all statutory requirements are indeed met?..

The application requires only a minimum of documents.
A cover letter is not a standard required document.
You are free to attach additional explanations if you feel something needs explaining in more details.

I just released I haven't put in all the home office records. Only from the point of when partner visa was granted from 2018. Before that had applications which were not granted.

Little history came to country 2007, over stayed. Applications were submitted (month dates unknown) but granted FLR FP and documented from 2018 onwards. That application has a summary of what applications had been made.

Shall I put in whatever we have pre 2018? Perhaps a cover letter is needed to explain..

Final thoughts. 2015 he was an overstayer. Applications to regularise stay was from 2016 so we will aim to highlight good character. Fingers crossed.

Did you say there are motoring offences? Overstaying is ignored if there aren't any other concerns on good character. You are very close to the 10 year limit after which overstaying gets ignored for good. Have you submitted already? If not, I would suggest waiting for a few months.

Yes so in 2018 offences (pure mistake due to paperwork) and then again last year caught out speeding on average speed area on Motorway. Absolutely by mistake/oversight. Points were taken and fine was paid.

We have settlement based on spouse so ILR has gone through fine this week.

I'm curious as to why a few months wait is prudent?

Because overstaying in the last 10 years is ignored only if there are no other concerns over good character, if other offences are present it is more likely the application may be refused.

Thank you. I have reviewed guidance and on FPN and traffic offences

"However, multiple fixed penalty notices over a short period of time, could demonstrate a disregard for the law and therefore demonstrate that someone is not
of good character."

We either apply now or next Aug when the 10 year within legal case kicks in place. All other good character is adhered to.

Have some research to conduct. Seen there are rules about getting ILR based on spouse and citizenship. Thank you again.

Overstaying
Where you are not disregarding immigration breaches relating to lawful residence, if
a person has previously overstayed permission to enter or stay in the UK, it will
normally be appropriate to refuse the application for citizenship, unless it is the sole
adverse factor weighing against the person’s good character
; and either:
• the person’s application for leave to remain was made on or after 24 November
2016, and the application did not fall for refusal on the grounds of overstaying
because an exception under paragraph 39E of the Immigration Rules applied
• the period without leave was not the fault of the applicant, for example where it
arose from a Home Office decision to refuse which is subsequently withdrawn
or quashed or which the courts have required the Home Office to reconsider
