CoS allocation for Tier 2 Extension

Post by aspirant910 » Fri Jun 25, 2021 11:43 am

Hello,
My Spouse current Tier 2 visa expires on 14th August. Her employer have applied for the CoS and saying that it may take up-to 8 weeks for allocation.
Is there any way to fast track this ?
I am assuming this she need a undefined CoS as she will be applying within UK, Does a new allocation is required in case of extension as well ?

Please suggest

There is a 5 working day priority service for "change of circumstances" requests which includes requesting the increase in annual undefined CoS allocations. It costs £200.
https://www.gov.uk/government/publicati ... ce-service

However, it is not supposed to be used for requests in progress but for an increase in CoS allocations I suppose a new request could be made using the priority service. Ask your sponsor to call the employer helpline 0300 123 4699 for further advice.

You'll need a new CoS for the extension application.

Thanks Manci, Looking at the threads in the board it looks like its taking 8 -10 weeks for getting a fresh CoS allocated to the organization.
Any further answers to below questions will be of help.
1. What happens if current leave to remain expires while CoS is still not allocated as in this case it may happen. Do employee have to leave UK and apply from their home country ?
2. Do you need employee details when you apply for CoS allocation ? or its required when you assign the CoS to an employee.
3. What are other steps once CoS is allocated before an application is submitted. How long it takes to assign the CoS to employee.

Thanks

1. You become an overstayer. You must leave by the date your visa expires.

2. No. Only needed for assigning a cos

3. It take minutes to assign a cos

Thanks, It 's been assigned today as told by HR . There is one minor mistake in CoS that my job code is : 2139 ( Job title: Quality Analyst Test Engineer) and its been marked as job in current shortage occupation list. Please suggest if this needs to be changed before applying the visa.

Skilled Worker (Extensions - ISC liable)
Tick to confirm if the job is on the current shortage occupation list: Y

SOC code 2139 is only for cyber security specialists. If you are not, your sponsor must cancel the CoS and assign a new one with the correct SOC code

2139 code is also for other professionals and comes under eligible occupation list. Its confusing that 2139 code is also under shortage occupation list but only applicable for cyber security processionals that's why HR may have selected wrong answer.
Hope my understanding is correct. As this is an extension with same code so not sure if this mistake in CoS needs correction or a sponsor note will be enough.

Assuming you are not a cyber security specialist the mistake in the assigned CoS was that the sponsor answered Yes to the shortage occupation question. The "only cyber security specialists" condition is in the shortage occupation list for SOC code 2139, it is not in the main skilled occupations list.

I think this will not be considered a significant error by UKVI and can be corrected with a sponsor note but ask your sponsor to confirm by phoning the employer helpline 0300 123 4699.
