Earnings and Cash Savings for Spouse Visa?

Hi guys,

I recently got married from aboard in Jan 2016 and started working in Oct 2016. However, my salary per annum is £16,000. I cannot get overtime at my work place in order to meet the finacial requirement of the spouse visa. I am looking for a part time weekend job but no luck so I am in a difficult and confused situation as I read that you cannot have a salaried and non salaried together so i dont want to apply for a job that is non salaried?!? But I am really comfused what to do as I really want to get this done quickly.. Any help, I would be highly grateful

It is fine to get a second job. It must be on PAYE so that you pay tax and NI and not just a cash in hand pub job for example. For the spouse visa, your income (from 2 jobs) must match your bank statement.

Thann you CR001 for ur quick reply! I have another question, would it be a problem if the part time job is temporary as you may be aware Christmas is ahead and there are only temp/seasonal work available??

Not anywhere near £16k im afraid. So if i grab myself a part time job even though its temp, im ok as long as I prove I meet the requirement for 6 months?

You have to have the same income for 6 months. Working seasonal over Christmas is not going to give you the same salary total for the full 6 months.

You have to submit the following to prove you meet the requirements.

6 months payslips (for both jobs)
6 months bank statements showing salary paid into bank for both jobs
Letter from both employers and employment contract if you have one

Thanks CR001. Do u think it will be a problem if its a temp job or a non salaried job as these are my main worries for visa refusal??

Everything else is ok as per relationship evidance

It should not be a problem no, but it must be consistent for the full 6 months.

Last question, with an income of £16,000 per year, how much saving would I need in my bank account held for 6 months prior to application?

More than £16,000 and it cannot be a loan. HO discount the first £16,000 as far as I am aware.

You would need £22,500 in savings as the first £16,000 is disregarded.

With £16,000 income you are £2,600 short of the required £18,600 p.a
£2.600 x 2.5 = £6500 + £16,000 savings = £22.500

Thank you. I was just reading the same thing on the internet. Will I have to put this into my bank account in order to prove that the money is mine or do I need to provide anything else?

The full savings need to be held in an accessible account for a minimum of 6 months. The Case Worker may also ask for confirmation of the source of the funds.

Now I have only read about this and I am aware of the method used with the shortfall, etc. But has anyone actually done this

However, regarding my cash savings, I do not have them in my bank account! I want to know how I can put this in and make sure that the headoffice know its my savings without doubt Would it be dodgy to put £22.5k into my bank account just like that? :S (What kind of evidence do I need to provide for this?)

Im looking at doing this before my pay comes which will be at the end of the month so that I can start my 6 month payslip journey and apply around May.

Your calculation of £22,500 savings is correct but these MUST have been held in an accessible account for at least 6 months on the date the application is submitted.

Also, be prepared for the Entry Clearance Officer to ask for evidence of the source of the funds.

You also need to provide 6 months payslips + the corresponding 6 months of bank statements.

Impossible to suggest how you can prove the funds are legitimately yours without knowing how you obtained them.

These are my couple of years of savings as I had plans to go Uni but ended up getting a really good job. Some of it is the money family/relatives gifted me on the wedding day which I kept saved and also I sold some unwanted gold. This is how I have been saving up. I have decided that I will take my savings to my bank and tell them to put my savings into my account as my personal savings so even the head officer does ask the bank they will say this is my savings and I personally had it put into my bank account which is fully under my control?

Am I right?? Please help, I'm really confused ans stressed out about this as I do not was a refusal

Half are with me and half I've given to a close relative for borrowing. So these are in cash format and will be obtained when I can confirm whether they can combine with my earnings

You will not be able to count the money towards savings that you have 'borrowed to a close relative'. The requirement is that YOU must hold ALL the savings in your account for the FULL minimum period of 6 months.

I havent borrowed, I have lent. However, My main question is that I WILL have the requirement amount in my bank account for the 6 months with the money being mine and under my control.

Where did I say you have borrowed I simply quoted what you said. If you have lent the money to a relative, you still cannot count it as you don't have it.

If you do not physically have the money in your own bank account for the full six months at the time of visa application, you cannot use it. You would have to put the money back into your account and wait another 6 months.

If money is under your control, then that is fine, provided it can be sourced.

If from sale of property, it does not have to have been for 6 months in your account, provided you can show that you have had property for over 6 months.
