EEA national married to British Citizen

Post by Anna_W » Sun Nov 22, 2015 5:40 pm

Hi! I'm EEA national, I married my British husband in 2006. Can I apply for citizenship straight way, or do I have to get Document Certifying Permanent Residence?

Assuming you are in UK & have been exercising treaty rights (continuously, for 5 years, as a qualified person - & with any absences from UK within prescribed limits) then answers to your questions are:
No.

Yes.

I have to get Document Certifying Permanent Residence?
You will need to do this as it is a mandatory requirement w.e.f. 12 November to submit PR proof for naturalisation. You won't however, have to wait 12 months on PR before applying for citizenship.

Have you been exercising treaty rights for the full previous 5 years?

Yes, I've been 11 years.
So, if I apply for Document Certifying Permanent Residence and I'll get it, I can apply for citizenship straight way then?

Yes, once you get the document, you can apply immediately for citizenship as the spouse of a British citizen. English B1 and LIUK is required for citizenship.

I've passed Life in UK test already, I didn't pass English exam, but I'm confident I'll be fine. Thanks for your replies.

Make sure you only do the English test that is approved and from an approved test provider per the link below

https://www.gov.uk/government/uploads/s ... ebsite.pdf

If the test/provider is not on the list, it won't be accepted. Level B1 required for citizenship.

Good luck.
