Not sure if it applies to unmarried partners (it may do).

Otherwise UK law (in this context) does not recognise EEA dual nationals who are also a BC as being anything but a BC.
And that is even before Brexit.

Dear Noajthan,

I hope you are well, do you remember the below conversation around the end of June, about "McCarthy transitional arrangement" as I and my wife were unmarried partners when that Oct 2011 RC was obtained, and she became British Jan 2016, however we are now married since March 2016. I'm also about to apply for PR as non-eea in October 2016

The only reason I am asking again about this it's just because when I have read about the above post when you have mentioned "Not sure if it applies to unmarried partners (it may do)", so my question now is does that affect me as me and my wife were unmarried partners and when even my RC was obtained on the basis of us being unmarried partners?

Mine was quite a linear application (EU National): same employer for the last 5 years, steady income with no gaps. The documents provided were from bank, employer, GP surgery, dentist, optician plus all the relevant P60s and 2 random payslips per year.

Just to reassure other people who never received an email: it's okay!

Hopefully all good as EFMs are treated as family members as long as they have an EFM RC.

NON EU (My partner has RC in 2008 and 2013). I had employment break in 2009 that is why he couldn't get PR in 2013. He has his RC valid till 2018.
I have a question, I submitted employment proof from 2010 till 2016. I was working part time 2010 till 2012. With annual income about 4K. But since 2012 until now full time. My partner non EU was in full time employment since 2006.
That part time employment can affect and delay in decision? We are really confused, and worried. Its about 160 days....
Congratulations, we applied in same category like yours, We sent on 16th march so we should expect answer by end of next week.

Well done andy75!

Just out of curiosity, what type of documents did you have from your GP and your dentist? Were they appointment letters or did you manage to get medical history letters from them?

Thanks

I bit concerned tho as my case is a bit complicated. So long story short - came to UK in 2009 with yellow card , in March 2011 received blue registration certificate which enables me in 5 years to apply for naturalisation. However the new requirement caught me and here I am applying for PR. In 2009 I work & lived in staff accommodation. The same place went on administration in 2012. We were not paid for 3 months , so I was forced to find another job. I did not receive a p60 for this year. Meanwhile I was living with my sister and her husband and did not exist on any tenancy agreement and etc. I changed a few jobs until I settled down in February 2013 in my current job. And live in accommodation again. I did not have any of my previous contracts so the only proof I got were my payslips..... As I said complicated!

Does anyone know if I did not sent enough documents and they refused what is the next step? Is there a next step or their decision is final?

Thank you so much for the reply! So I still need to wait another year in order to apply for citizenship?! I am still confused as I read that : https://www.freemovement.org.uk/eu-nati ... lications/

The example means that I can apply now or not? Sorry just still very confused!

It would be better to ask in BC forum.
This apology of a topic on 'PR' is enough of a jumbled mess already.

For a Section 6(2) BNA application, no need to be free of immigration time restrictions (ILR/PR) for 12 months.
Apply as soon as other requirements have been/can be met; have you checked them?

For a Section 6(1) BNA application, there is a need to be free of immigration time restrictions (ILR/PR) for 12 months.
That means to have/hold the ILR/PR status for a year, (not necessarily to possess a PR card for a year).

Which are you, 6(1) or 6(2)?

That answers it, once and for all. It doesn't matter if you lived legally in the UK as an EEA national excercising treaty rights for 5 years or more. Your ID must be valid when you apply.

If you are fortunate enough to have a British spouse its 6(2).
If not its 6(1).

Unfortunate.

Good people tried to caution you:

Identity check is one of the first stages the application will go through, you need to prove to caseworker you are a Union citizen.
Case law of Barnett may help you.

Thank you Noajthan,

For example, Just an example,

Based on Section 6 (1) :

I'm an EEA family and started to live in UK on 01/01/ 2011. I have had a resident card for 5 years since 01/06/2011, and my PR card is dated on 01/09/16.

Then, can I apply for citizenship any day after 01/09/16 ? Or do I have to wait and apply for it after 01/09/17 ?

Forget about dates on cards.
Figure out when you acquired PR.
