EEA FM (unmarried partner) relationship broken down

Post by KennyG86 » Sun May 19, 2019 4:27 am

Hi, I am from Ghana. I arrived the U.K. in September 2010 on a Tier 4 visa. I switched to a PSW in 2012 and back to another Tier 4 visa in 2014 to start my PhD. In 2016, I got an EEA FM (unmarried partner). Thus,I was in a durable relationship which has now broken down. I want to know my options if/when my ex decides to notify the authorities. Does my residence card - which expires in February 2021 - get curtailed immediately?

if you were not in a marriage or civil relationship, the rules will be applied differently and your rights will be lesser. You might have to find some other category under which to apply. Home office will cancel your RC if you let them know. You decide what you want to do
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

Thank you very much for your reply. My ex says she gives me till September. Is there a time period in which the curtailment happens? Is it immediate? How much time would I be given to apply under a different category from September ?

As an unmarried partner, your rights and right to residence under the EU rules ends when your relationship does. You have no automatic rights as an unmarried partner.

If you can hold until September 2020
Then there is a possibility you can apply for ILR long residence
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

How when the rights end when the relationship ends?? ILR LR also requires extensive evidence of the EU partner exercising treaty rights for the whole period being claimed under the EU rules.

Dear All

Thank you very much for your replies. Can I please clarify, would it be worthwhile to wait till September 2020 to apply for an ILR? I need some real clarity on this. Thank you very much in advance.

How are you planning on waiting if you are no longer in a relationship?

For ILR based on 10 years long residence, you have to submit substantial evidence for the whole time you are claiming under the EEA/EU rules to prove your partner was a qualified person exercising treaty rights and that you are still together and that your rights continue.
