Eligibility to apply British citizenship

Post by Alan34 » Mon Jan 11, 2021 10:38 am

Hi,

I got ILR(brp card) today. I applied for ILR as tier 1 general PBS dependant. When can I apply for British citizenship.

1) can I apply for citizenship immediately or do I need to wait for one year?
2) can I travel outside UK while my citizenship application is in process?

Please advise on above
Many thanks in advance.

1. You can apply now as your spouse is British, provided you meet the 3 year residence and physically present at the start of the 3 years requirment.

2. Yes

Are you married to a British citizen?

If yes, you can apply immediately.
If no, you need to wait a year from the date of being granted ILR.

Also keep in mind that in the former case, you need to prove that you were physically in the UK on the day exactly three years before the date of application, while in the latter case, you need to prove physical presence five years before the date of application.

EDIT: Overtaken by CR001.

My husband is British citizen now. He got his citizenship one year after ILR in 2018.
1) Incase if i have to prove my presence in uk, what documents do I need to submit.

2) do I need to provide HO additional forms or information that I will travel during application process?

1. You don't have to prove physical presence. You are required to submit all stamped pages of your passport to prove you meet the absence limit.

2. No.
