eligibility to apply to settle in the UK as a PBS dependent

Post by dependentILR » Mon May 06, 2019 1:43 pm

Hello,
I am writing with regards to my eligibility to apply to settle in the UK as a PBS dependent, i will be thankful if you can kindly let me know if its possible.
My situation is as follows,
I have been married from May 2011 and have been living with my husband from then,

1. Arrived in UK : 01 Feb , 2012 - ICT Short term Visa
2. Moved the Visa : 09 Oct 2012 - ICT long term Visa
3. Moved Visa again: 05 Aug 2014 - Tier 2 General Dependent visa and currently on the same visa valid till Dec 2019

also NOTE: all this years i have not been out more than 180 days outside UK.

My questions are as follows:
1. Condiering my husband currently has an ILR And we have been together all these years in UK [for 7+ years now], am i eligible to apply for ILR myself as a PBS dependent considering we have been together for over 5 years on different visa? Or Should i complete 5 years on the dependent visa to apply for ILR?
2. Given i need to use my Dependent visa to apply, the 5 years on it will it be considered from the day i was awarded the Tier 2 general dependent visa or the day when i entered UK on the dependent visa?

I will be thankful if the above questions can be answered please.

Thank again for all the help !

On what basis did your husband get ILR, 5 years PBS route or 10 years long residence??

You can apply for ILR no sooner than within 28 days before the 5th anniversary date of your initial Tier 2 Dependent visa start date, ie 5th August 2019 minus 28 days.

You need 5 years on a PBS dependent visa to qualify for ILR. Your previous ICT visa doesn't count.

Thanks for the very quick reply, appreciate that.
Just so i can confirm, although i entered UK a week later after the Tier 2 Dependent Visa was granted, i can consider the date when the visa was awarded and date back 28 days to apply for the ILR. Please correct if my understanding is wrong
