Employers not informing border agency

Hi,
I resigned from my Job as on 30.09.2015 under constructive dismissal because of harassment, bullying and discrimination by my employer. I was on Tier 2 visa and is due to expire as on 26.01.2016. i had to seek help from my trade union and have a solicitor who is dealing with the ACAS conciliation service. Meanwhile my employers have not informed the border agency, nor have they sent me my P60 form. I called up the border agency who only informed me that I will have to wait for the letter. It has been 45 days since my resignation but no intimation from home office. My employers have also been buying time and delaying the legal process either on pretext of illness or on being vacation and have not been helpful at all. I don't know how should I be handing this matter any further as i dont know if I should irrespective of my employers non co-operation, should submit my visa and passport and if so where do I send it ? Could you please help, what I should be doing as I have made numerous calls to the border agency but only end up facing recorded message! thanks

What do you want to submit your visa and passport for and to whom?

If you are not changing sponsors, you can leave the UK whenever you wish, no need to wait for a letter.


P60?? Do you mean P45!! P60s are only issued AFTER the tax year end. P45 is when you leave an employer.

Thank you for the reply. I managed to find a new sponsor who were very efficient in sorting CoS out in just nick of time :-)
