Hi
What is the process and waiting time for a british citizen sponsoring non eu spouse to france on a spouse visa if he is working there from last 3 months pay 1200 euro a month.

Helpful if you can state which country you have applied for a spouse visa instead of multiple different topics about spouse visas in different countries.

Your spouse needs to apply herself from there.

Choose:

Main purpose of stay : Family of EU

These are the docs she is going to need to present:

Pre-requisites

CERFA form n°14076*01 or 14571*05, duly completed, dated and signed

ID photographs (2)

If you are not a national of your country of residence, please provide proof of your legal residency in this country (e.g. residence permit, etc.).

Travel document, valid for at least three months after the planned date of return

Civil status

Proof of family relationship (civil registry certificates)

Proof of the nationality of the EU or EEA national

Purpose of travel/stay

For minors, birth certificate, permit to reside in France signed and legalised by both parents, and a document specifying the right of custody in the event of the separation of the parents; only the authorisation of the parent who is not travelling with the child seems to be necessary.

Proof that the person is accompanying or will join the Swiss/EU/EEA national

Visa is issued free of charge

It depends on the consulate.
Legally they have to process such visa applications (EU family member visas) within two weeks.
Your application should be considered a priori by them (legally).
And you (well, your spouse) can request to directly apply at the embassy (legally).

Keep in mind that she can also apply for a short stay / visit visa AND extend it (ie, get 5 year residence permit) the same way in France. This would mean not dealing with employment, address etc. documents.

British Citizen in France shall use this route (EU law i.e Directive 2004, at least until Brexit happens).

Looking into the link provided above under the UK section:

Your two initial applications have been refused for reasons including false documentation. Chances are your EU application at this time for France CAN also be refused since false documentation are grounds for refusal even under EU law. I believe UK visa refusal automatically means a stamp on the passport indicating the refusal number and decision date. Although French immigration officers are not obliged to decide based on UK refusal, if they do get into the details of that two prior refusals and find out false documentation was the grounds of refusal, you can always assume it is not going to go good and you end up having to appeal on both fronts.

I suggest you await the decision of appeal to prove your innocence in this matter.
