Travel to Germany with BRP Card only?

Post by Bucki » Thu Nov 26, 2015 11:36 am

Hii Guys

My wife arrived in UK on Spouse Visa for 5 years (extending after 2.5 years) and received the BRP Card (Residence Card). She is from a non-EAA Country and has the UK Visa on the passport.

Can we travel (fly) together to Germany for a week or so ??
Is there a special requirement? if so, what is required to do ... etc ?

Please advise, thanks

PS: I am British by the way.

i recently contacted the german immigration and asylum services by email to get some info about something
related to your case.kindly have a look i hope it will help.

Important hint:
If you already had a residence card EU issued by another EU Member State (section 2 para. 4 sentence 3 Freedom of Movement Act/EU), you can enter Germany visa-free.

The German mission abroad can provide you with further information.

In Germany you will get a residence card at the Foreigners Office (Ausländerbehörde) in your local area (sec. 5 Freedom of Movement Act/EU). You can find the corresponding Foreigners Office here.

Please find all information here: http://europa.eu/youreurope/citizens/index_en.htm

If you have problems with the Embassy, you might contact the Federal Foreigner Office for further assistance: http://www.auswaertiges-amt.de/EN/Startseite_node.html

Best regards,

On behalf of the Federal Office for Migration and Refugees

Hi khanmzk

THanks for the email.
Not sure if you understand it right ...

my wife is from a NON-EEA Countries and she only has BRP Card.
on her passport, she got the UK Spouse Visa.

Our intention is to visit her brother in Germany for 1 week and return in UK.

Is it a matter of applying for a SCHENGEN VISA ?

A UK spouse visa does not allow free travel in the Schengen zone. A spouse visa is issued under the UK immigration rules and not the EU/EEA rules. The spouse visa is specific to the UK. She should apply for a Schengen visa, which should be issued free of charge if you are a British Citizen, a handling fee might be applicable if applying through the visa facilitation service though.

@bucki i clearly understood your question. You are british national and your wife is NON-EU national residing
in Uk on spouse visa which is granted to her by british government under british national law.She can not travel
to germany without visa Becuase she do not hold a residence card which is issued under article 10.therefore
she need a entry visa to germany a simple tourist Visa will work and it will be issued free of cost .for understanding about article 10 resident card kindly have a look into this link.i hope it wil help.

If she has a valid Schengen visa, she is free to travel on her own.

Sure, she can travel on her own (without my present) to Germany once it has been granted.

She is not applying for anything (residence card) under the EU directive/regulations with you as a spouse. She can travel with you and she can travel without you on a Schengen tourist visa.

Who is telling you that you have to travel with her??

some of my British friends who apparently know what are talking about.
(or rather not in this case)

well, in this case.
will have to fill out a form (http://www.vfsglobal.com/germany/uk/vis ... ocess.html)
set an appointment at the Embassy in London.

down side:
- not sure how long they take to process the application
- wish it was processed within the same day.

Takes about 10 days, sometimes quicker depends on the time of the year.

Hi Again

is there any restrictions to how many days I can apply for ?
let's say for 1 month?? then surely they would want to know where I get the money from right?

never the less, assume they give the visa etc.
will then my wife be able to travel to and out of germany as many as possible during the 1 month visa?
example, fly to germany for 1 week and come back to UK and then after few days fly back again!

logically, I would say "yes, as long as the visa is valid" but not sure.
