Appreciate your input, Directive/2004/38/EC. Apologies - I did not see the replies to this thread until just now.

Is there anything about the definition of residence, according to the Directive, of which you are still unclear, republique?

Would you be kind enough to quote the text in the Directive, national legislation, or relevant case law which says "if you have no intention to be a resident, you are not a resident", or any of your other claims?

That is, if you are willing to read the legislation.

Surely freedom of movement itself is a Treaty right and therefore by simply entering a member state, a Treaty right has been exercised?

As EU Citizens, we can (in theory) hop from one member state to another without restriction and that extends to our Family Members.

To me, this is a no brainer, the OP can work legally in any member state if his spouse is along for the trip just as the EU Citizen themself could do if they wished. There is no requirement that I have seen that the EU Citizen intends to reside there, it is just another right they have if they want to invoke it.

For this purpose, perhaps just consider the entire EEA area as one country governed by one set of rules?
