EU with settled status in UK to bring NON-EU Fiancee for marriagee

Post by EdandJoy » Mon Oct 21, 2019 8:19 pm

Hi Everyone,

Just to give you a short overview, I am EU citizen, I live in UK and have my Settled Status (ILR) letter since a few months. My fiancee is Phillipino ans she lives currently there. Our relationship started 3 years ago, we never lived actually together, we just visited each other as often as we could.
My question is if there is any kind of visa for EU Settled people to bring their fiancee here and get married in UK? (so after marriage we can swap with a Family Member - EU Residence Card)?
I know of the Fiancee Visa under the Family Visa umbrella. This is a very complex and expensive application though, thus my question if there are other routes for our situation. If not and the Fiancee VIsa is the only option that exists, could you please advise if it would be possible after the Fiancee Visa and getting married here in UK, to swap for a Family Member - EU Residence Card? Or it must be the Spouse Visa which is under the same umbrella as Fiancee Visa?

Hope my questions make sense and I really hope to get some insights from you. Feel free to ask if you need some clarifications from my message.

Thanks in advance!
Ed

I think the easiest option is to first get married (say in Philippines) and then to apply for Family permit.

You cannot swap Fiancee visa in UK. You need to:
1) get fiancee visa
2) get married in UK
3) go back to Phiilipines
4) apply for Spouse visa

This is expensive and long. Hence my initial thought: get married outside of UK and apply for EEA route. Its easier and free of charge. You can always do a family wedding later (if that's the idea).

You appear to be confusing a fiance visa with a marriage visitor visa. After marrying in the UK while on a fiance visa, the spouse would then switch to FLR(M) without returning home. :!:

Agreed with Respect Casa!!

But it's expensive route, better to get marry in Phil and apply for EU Settlement Scheme Family permit.

A friend of mine did this 3 weeks ago and her partner who were married in Thailand got her EUSSFP in 2 weeks only.

{ I'm not a solicitor, legal professional or immigration advisor, all of my posts are based on my online search and my own PR, ILR (LR), 2 FTT and 2 UTT refused but finally after 3 years of long battle I got my SETTLED STATUS. }

Thank you all for your insights! We did realize recently that this is a more costly route, but a really important question still remains: after the Fiancée visa and getting married here, is it possible to apply for the EU Family member card? This is very cheap and a good option for us. We would like to know before starting our endeavor, if we must continue later with spouse visa because of the fiancée one, or we can swap with the EU one. I really hope to get some insight on this.

Fiance Visa requested issue date

Post by EdandJoy » Fri Nov 01, 2019 10:54 am

Hi Everyone,

Me and my fiancée are ready to submit our Fiance Visa application. She will be able to travel to UK from 3rd March 2020. We were wondering that, if the visa gets processed faster, would they issue the visa starting with the date mentioned in the online form (3rd of March), or from the date it was processed? This would complicate our situation because would move forward also the interval we have left to get married and apply for the spouse visa.
I really hope to get some insight from you with regards to this.
Thank you,
Ed

It's supposed to be valid from the date you specify, unless the date it is processed is later.

I'm just a guy on the Internet who immigrated to the UK. My opinions are based on my experience and interpretation of the immigration rules and should not be considered legal or immigration advice; your mileage may vary.

A visa can only be post dated to a date in the future up to 3 months in advance if you specifically request this. Applying now is too early.

If you do not, the visa is issued from the date of approval.

A fiance visa is issued for 6 months and not 30 days!

Thank you everyone for your inputs, I really appreciate it!
We just submitted the online aplication, got our GWF number and is all good so far. The only surprise and problem is that we haven't been asked to pay the health insurance... We use gov.uk to do our online application and there was nowere a step or a link to pay the insurance. We paid the visa fee ($2056 - I don't understand why UK would ask the payment in USD but it's fine) and then they sent us to the VFS website...
Did anyone followed another route to pay the health insurance and get the IHS number?
Kind regards and thank you again,
Ed

IHS is not payable for a 6 month fiance visa.
