Re: 180 days restriction & frequent travels for Work

Post by hugekit » Wed Feb 07, 2024 11:57 am

After obtaining my spousal visa I could not secure good job in UK so I work overseas and this makes me to travel often outside the united Kingdom.
In the first year of the initial 2.5 years residence permit i exceeded 180 cumulative days outside the UK due to work commitment and during Covid-19 in 2020 i also exceeded 180 cumulative days outside the UK due to flight restrictions and expired passport.
During covid-19 my international passport expired, I could not renew it because of work restriction in my country - government agencies were not working. Secondly I could not travel because of the embargo on international flights to the United Kingdom. I have evidence of both issues (expired passport and communication with the British High Commission)
But since 2020 i have been in the UK each year for more than 180 days.
Moreover I had cancer in 2022. I was treated in the UK and was confirmed free of it in 2022. But there is a mandatory 5 years follow up with two teams in the specialist hospital in UK.
My BRP expires in April 2024. What are my chances of success with the ILR application. Can my case be treated under discretion?

There is no such 180 days absence limit for a spouse visa holder

Financial Year Cut-off Date & Items on the Checklist for the ILR application

Post by hugekit » Wed Apr 24, 2024 3:01 pm

Good afternoon. Kindly advise me on the following:
If I submit my application on the 5th of April 2025 being the last financial day for 2024. Can I still submit the 2023/2024 HMRC Tax returns document with my application or I need to prepare and submit the 2024/2025 HMRC Tax return before my biometric capture date?

Secondly, can i submit P45 in lieu of the P60 if the P60 is not readily available, even though the P60 is already included as part of the submitted application checklist.
Thank you

A bit of background may assist in understanding what you seek.
What route are you intending to apply on, how do you intend to meet financial requirements?

Many thanks. I am on the 5 year programme with a BRP on a spouse visa. I have completed the 1st 2.5 years, the next step is to apply for ILR with my wife as my sponsor.
The intention is to provide evidence that my wife meets the financial threshold of 18,600GBP through a combination of Self employment and employed, by submitting SA302 and self assessment document and P45

If you have only completed 1 x 2.5 year spouse visa time, then you do not qualify for ILR (indefinite leave to remain). You need to be applying for a second 2.5 year FLR(M) visa extension, which is different to ILR.

Can you confirm which form you are completing so I can move your topic to the correct sub forum?
